    ATF Rips Off Another Gun Dealer in Arizona
    Confiscates 274 guns and 3,000 Form 4473's Without making an official arrest or even filing charges

    November 1, 2000

    "They were throwing vintage collector's items in mint condition through the air and into a trashcan 10 feet away," said Jerry Michel, licensed gun dealer, after being assaulted and pillaged by the ATF. "I felt like I was going to throw up."

    And so might you before you're done reading this report.

    On October 25, 2000, The Bureau of Alcohol, Tobacco and Firearms sent approximately 30 federal and local agents in stormtrooper attire to confiscate firearms from a dealer who, according to what they told him, "did not have his papers in order."

    Jerry's Guns & Ammo d.b.a. Specialty Firearms of Mesa, Arizona was the latest in a long list of gun dealers who've been paid a visit by people who, when rightly told, "You're not supposed to do that" respond by saying things like: "We're the ATF. We can do whatever we want."

    According to Jerry Michel, that's what they said to him when he confronted them as they threw a 1960's Winchester Model 94 Antique into a trashcan that already contained a few dozen of his guns. Though the classic, mint condition gun was still in its original box, they removed it from the box and tossed it into the growing pile of firearms ranging in value from a few hundred to several thousand dollars -- metal slamming against metal, metal gouging wood, etc. -- like one might toss so much kindling onto a campfire.

    These government operatives also confiscated guns Jerry held on consignment for several customers, and they also took his personally-owned firearms along with guns he'd been storing for an ailing friend.

    When I called ATF today to find out if it is standard operating procedure to wantonly damage collector's items when they are stealing them, Larry X said,

    "They didn't do that. They don't do things like that."

    "Were you there, Larry?"

    "No, I wasn't."

    "Then how do you know they didn't do that, Larry?"

    His response made me laugh: "Who am I speaking with again?"

    You should be able to see the above actions on color video. Jerry installed video surveillance equipment at Specialty Firearms some time ago and uses it consistently during hours of operation, too. He'd only been open for three minutes when he was lured out the front door under false pretenses and surrounded by heavily armed and body-armored gun confiscators, so there was a new tape in the player and the tape was rolling. But ATF confiscated the tape that shows them unnecessarily and irreparably damaging Jerry's property -- and broke his VCR in the process.

    I am sitting here reading -- for the third time -- the search warrant, given to me by Jerry himself, and I can't seem to locate the words "video tape" anywhere on the warrant.

    The video tape will be subpoenaed to prove damages, we pray, in a class action lawsuit against ATF. Will it mysteriously disappear?

    Jerry's crime? Apparently, in Mesa, the city has an ordinance requiring gun dealers to have a "pawn permit" if they sell used firearms -- or so he was told while a team of armed and consistently disrespectful "men" busied themselves stealing 274 guns with an estimated value of approximately $300,000.

    "How much is the pawn permit," you ask? $100.

    Jerry Michel's Federal Firearms License (FFL) is current, so he is in fact a legal gun dealer. In fact, he's had his FFL since 1986, continuously. He does business with approximately 285 other gun dealers around the nation, and his reputation is one of integrity and lawfulness. No arrests or prior convictions, at all. Not even a speeding ticket to his name. Jerry is a "by the book" kinda guy.

    Except for that little permit said to be required in Mesa. And that is only if the ATF was telling the truth.

    Jerry's business and personal quarters were trashed entirely, all drawers emptied as if the place had been looted. When he asked if he was "out of business," he was told he could conduct business as usual. When he asked what he was supposed to sell, one agent's response tells all about the ATF. "You can sell some of this ammo," he said with a mean, sneering chuckle.

    We were sitting in my vehicle in a parking lot of an auto parts store in Mesa as Jerry was feeling a bit uncomfortable in his home and business.

    "I have operated my business by the book to the very best of my ability since day one," Jerry stated matter-of-factly. "In fact, I have sold many guns to police officers over the years, and I've worked on a lot of cops' guns, for quite some time. I respect the law. I have a lot of friends who are good cops, and I respect them, too."

    But the law no longer respects gun dealers like they once did, a fact Mr. Jerry Michel now fully and very personally understands.

    "I don't have anything to hide," he said quite clearly, exasperated. "I am not a criminal. "Why wouldn't they simply call me up and tell me I need to come down and pay for some $100 permit? That is what an aboveboard and citizen-supportive organization would do."


    Jerry says "You know, before this happened, I thought the ATF was getting a bad rap in the gun community. I've only ever had them be polite to me. I used to welcome them in and we'd actually chew the fat, you know, talk like people. But after this experience, I can see why you say that. What they did to me and to my property is wrong. And you're right about their perspective on the right to keep and bear arms, too. One of them asked me, "Are you one of those constitution fanatics?" I said, "Well, I believe in the Constitution, don't you?" He ignored me and continued trashing my place while I sat helpless, handcuffed and with guys behind me holding guns on me.

    Every bad thing you've heard about the ATF, I'm sorry to say, is true. They entrap you on some asinine technicality and destroy your property while you're cuffed, and they point loaded guns at you. They steal your entire life's collection and throw it into a heap like it was trash. They belittle you, degrade you, and they attempt to get you to admit to things you did not say or do, and they enjoy it.

    Be careful, and follow every little tiny detail of the increasing red-tape regulations, and they still find a way to justify assaulting you.

    JM: Angel, listen, my mother just got out of the hospital again, and the slim margins from my gun business have been helping me and my sister take care of her. They've also just stripped me of my retirement. That's right, MY RETIREMENT. I had planned on selling much of my collection some time in the next few years and retiring, and now it's all gone, supposedly because of some $100 "pawn permit."

    They trashed custom guns that used to make people do a double-take when they saw them. My customers would say things like, "I didn't know a gun could look so perfect." And they threw those perfect guns of amazingly high personal and financial value into a trashcan. Am I angry? You bet I am. I don't even want to sleep at home, and my home is behind my shop, so it's all one big ugly mess now.

    They've not only successfully run me out of business, my mom called me today and told me she felt like she was having a heart attack just thinking about what they've done to me. I know the ATF has killed innocent people over their guns, and now they have compromised the privacy of over 3,000 of my customers by confiscating my sales records from the last 15 years. THIS IS AN OUTRAGE!! They even threw the business proprietor next door up against the wall when he walked outside to see what was going on -- and patted him down, when he did nothing, and that is an illegal search, isn't it?

    Jerry has every right to be livid. I read through the 23-page list of guns the ATF took from him. When I called ATF today, I was told he's not even been charged with anything, nor would they disclose their justification for committing such an offensive operation against a man who bends over backwards to comply with laws. A phone call would have yielded their supposed $100 "pawn permit." And, the search warrant -- in my possession -- does not name some of what was taken, nor is the list (of confiscated guns ATF agents left with Jerry) a complete list.

    I just got home from the most disturbing sight I have ever witnessed. Earlier today I tried calling the gun dealer that I have known and purchased from for 4 years now. The phone was busy for hours, and when I did get through all I got was his answering machine. Very unusual. I drove over to his shop and found the parking lot jammed with unmarked, tinted windowed cars, along with an SUV pulling a Mesa City Police trailer.


    Why are there no charges when 30 armed-to-the-teeth "men" assaulted a man, confiscated 274 guns and over 3,000 records that show private information of 3,000 Americans? Where are the charges?

    Jerry Michel asked more than once if he was being arrested, and he was told "NO, you're being detained." If this man wasn't even arrested, why were prints and mugshots taken?

    And why was the video tape taken from Mr. Michel's surveillance equipment? Inquiring minds want to know. Surely someone has an answer, but it sure as Hell isn't Jerry Michel. He's dumbfounded.

    Jerry Michel gets the closing statement today, as follows: "If these guys will do this to me over some $100 permit when I was already licensed to sell firearms, I shudder to think of what they would do to someone over a $10,000 violation."

    That made me sick. With every action like this these morons give sustenance to people with Ryder trucks full of fertilizer and diesel fuel. I’m sure Janet Reno will get to the bottom this right away.

      Easy, Mickey: when you start talking that Ryder truck sheet, just remember that almost everybody who gets smoked in those deals have nothing to do with this situation.

      John: I hate to tell you this, and I don't know where you got that, but that whole "story" reeks of B.S. from beginning to end. Not even halfway through it my bullsheet detector is redlining.

      Sure if that story is true, that's horrendous. I'm not buying it. Too many red flags. For instance:

      -"[They also took] guns he had been storing for an ailing friend."-- LOL! An "ailing friend"?!

      -ATF agent "Larry X"? LOL! What, Larry can't give his last name? How did the guy get in touch with him?

      -Why would they lure a guy outside of his gunshop to do all of this? Why would they need 30 agents?

      -He had a videotape which they confiscated. So, they just happened to do all this in view of a fixed camera. Then--the HORROR--they TAKE the videotape and BREAK HIS VCR to add insult to injury?! Did they kick his dog on the way out, too? LOL.

      -They then completely trash his legal gunstore, breaking sheet everywhere (not to mention his now-dead VCR and all those guns) and then an agent "sneeringly chuckles" that well, maybe now he can sell the ammo? Come on!!

      This whole thing reads like a amateur fiction that you usually have to get in Penthouse Forum or in one of those SCARS ads. Pure, unadulterated bullsheet propaganda. And badly conceived at that.

      Dude, I cannot believe you think this is real.

      I'm not questioning your stance on the issue--I'm well aware of that--but I can't believe you're offering this as a call to arms (pun intended). But somebody's pulling your chain.

      I hope it's not crap like this that's getting you guys all riled up.

        No $hit? You miss the point. I was not advocating that type of action, merely making the observation that the ATF’s bizarre actions adds fuel to the fire for people who DO contemplate such actions.

        It IS a LARGE stretch to believe that the same people that executed flawless operations like those in Waco, or the Weaver case could have possibly done something as heinous as described above.

          Oh, God. Come on, Mickey! I know you guys hate the feds and ATF and all that stuff but you can't see right through that "news story"?

          I'm not questioning whether sheet like that happens, but that account above is laughable. They forgot to include jackbooted ATF agents slapping the women around, taking their children and torching the place while cackling with glee.

          This is propaganda 101 stuff, which was obvious in the first paragraph. They could at least get a better writer.

            That’s a pretty good description of Waco you just put together. The story may be true it may not be. Unlike you, I am not willing to dismiss it due to the lack of skills displayed by the writer or an ATF agent that refuses to give up his last name. (if there was an iota of truth in the story would YOU give out your last name?)

            I am willing to believe that it is possibly true because it mirrors numerous other actions taken by the ATF (or for that matter the FBI and the IRS) in the past.

            You, on the other hand, are unwilling to even entertain the possibility that it might be true because you didn’t hear it from Diane Sawyer.

              No, Mickey, it's not that I don't believe something like this can happen if I didn't get it from the Jewish controlled liberal media.

              Give me some credit, dude. I'm not taking sides here--I'm trying to point out to YOU guys that this is a joke of an account. If it did happen, it's been completely embellished. I could go point-by-point on why, but it's such an obvious piece designed to arouse the fury of its designated audience with these hysterical descriptions.

              You see this very common kind of "account" often if you've ever studied propaganda. Whether it be racist, anti-Jew, anti-American, anti-Cliton--whatever. This is very 101 stuff, as I said before, and hack work to boot. That's what tipped me off--not because I'm defending the U.S. Government, The Feds, The ATF, gun control or anything like that.

              And if this is the case, then it bothers me that people are trying to manipulate people or anger them into action by distorting things in a way so emotionally volatile that people end up doing things based on misinformation.

              Ask Hawk to tell you about the phenomenom of "Lone Wolfs," who's the most famous example of one, and what inspired him to do it.

                  Lets answer some of your questions.
                  First on Larry X. Is it inconceivable that a fed would
                  not give his last name, especially when he caught the drift of where the conversation was headed?

                  Second, as why lure the man outside his store? Well most gun shop owners I know have guns in their store and keep them loaded. In large stores in large cities they may even be wearing them. Now, if ATF or anyone else was to come into my place of business, and ruin everything I had and had worked so long for, it would certainly be in their best interest to get me away from anything I could use against them to not have to watch my whole life go down the tube.

                  Third- Why have 30-1 odds? Well, in the past, the way they got their tails kicked in Waco when going against a bunch of
                  women, kids, and a few dudes, I'd say old Jerry had them outnumbered.

                  Whether true or not, and I have no reason to doubt it, based on the past, its certainly possible.

                  I'm a little surprised at someone whose well read on the JFK assaination, and all the witnesses in Dallas who were told what they saw, whether it went down that way or not, that you would be so surprised by this.

                    Well, Hawk, it is for those same reasons that I dismissed this from the outset. Plus, I cannot believe that you didn't notice it right off the bat, too, for what it so obviously was. Especially being somebody who was around during the McCarthy era.

                    If you want--and like I said, I don't want you positioning this as me taking the Feds side, 'cause that's not what I'm doing at all--I will disprove this account to you.

                    What I am telling you is that this account is either entirely fictional, or grossly exagerrated.

                    I can find out, actually, with the resources I have. If you really want to know.

                    I know you guys are behind the cause, but when people for the cause start distorting things and lying, then they're hurting you, too.

                        I'm with Tony. Very amateurish.

                        The government should follow the book, and there's no excuse for Ruby Ridge, but the a-holes at Waco got what they wanted when they set the place on fire. It's easy to second-guess Janet Reno when everyone and their brother isn't breathing down your neck to get the job done. Too bad about the kids.

                            Well, Tony 10, as far as tag teaming, I try to say it like I feel it. If that goes along with what someone else says or vice-versa, then I guess we feel the same way. John lives right up the road from me and I know him personally so I doubt he's BSing. However, if you can disprove it, please do.

                              All I can say is ...

                              Now Jerry knows what a DOGMAN feels like. Fells like sh!t, doesn't it Jerry ... except our dogs are living, breathing, happy creatures with emotions that we get to see carted off to their death. All this if some body "believes" we might possibly have had the "intent" to make one dog nick another's skin. They'll treat you just as sh!tty and yes they will haul off a whole yardfull of dogs to be "humanely disposed of" because of course it is much more humane to exterminate (er, um, "put to sleep") pit bulls than have them "possibly" be fought.

                              Prohibition of any kind is insane. It is evil. And it is typical of herd-like human beings who meddle in the affairs of others. I don't know who wrote this, but it was said in the 18th century:
