Dacono teen still alive when police arrived

DACONO — The man accused of killing 17-year-old Kyle McCune told officers he acted in self-defense when McCune attacked him with a sword, according to a police affidavit released Thursday.
Brodie Levi Clayton, 18, faces second-degree murder charges for the death of McCune on the morning of Feb. 24. Weld County prosecutors on Tuesday released Clayton’s arrest affidavit, which described the events surrounding the fatal stabbing.
Frederick Police Officer Donald Loveless responded to a reported stabbing at 546 Fourth St. in Frederick at about 2:30 a.m. Feb. 24. He found McCune on his back on the kitchen floor, according to the affidavit.
Homeowner Kurt Kudrna told officers he came home from work and found McCune stabbed, the report said.
McCune was conscious, was bleeding from his chest, and had a faint, sporadic pulse when Loveless arrived. The boy grabbed the officer’s pant leg and continually moaned, “I’m going to die,” according to the report.
Paramedics took McCune to a Loveland hospital, where doctors pronounced him dead later that morning.
Kudrna’s son and another boy also were at the home. They told officers McCune and Clayton had gotten into a verbal altercation that escalated and resulted in McCune being stabbed.
The officer noted seeing a knife and a samurai sword in the living room of the home, as well as blood stains leading to the kitchen, according to the report.
By 3:30 a.m., officers found Clayton behind the backyard fence of the Kudrna home with his arms raised, offering to turn himself in.
“Can I have a chance to tell you my side of the story?” Clayton said, according to the report. “He came at me with a sword.”
Clayton later admitted to officers that he had stabbed McCune but insisted he did so in self-defense, the report said.
Clayton, who lives in Lochbuie, will appear in court for an arraignment on March 15. He also faces unrelated felony charges, including possession of a weapon by a previous offender, theft by receiving and second-degree assault involving a knife, according to the police report.
McCune, the son of Dacono City Councilman Tom McCune, was honored during a March 1 memorial service.
