    My husband was in an accident in August, it was his fault. He paid the ticket and then had to do an online course to avoid points on his license, but since neither of us have any accidents or tickets on record, our auto insurance rate didn't even increase. Our vehicle was totaled. The other vehicle was driven away and the driver refused treatment at the scene. I'm not saying the other driver couldn't have been injured (DH was hit stopped at a light by someone texting years back and walked away but then had problems later on), but no one left in an ambulance. DH's arm was burned from the airbag and our daughter had a scrap on her collarbone from the car seat harness but the seat did its job. We just got an email from our insurance agency saying a lawsuit is forthcoming and instructing us to not respond but pass on any information to them so they can assign an attorney. I'm not super worried yet because...this is why we have insurance, right? But how worried should we be? If there is a lawsuit would DH have to appear in court? Do we follow along with what the insurance company says or are we supposed to get our own lawyer? Our policy has 500K in bodily injury (I always choose the max available). We had umbrella insurance but DH never renewed it (major eyeroll! Like the ONE task I asked him to do last spring and didn't realize he never did) so we don't have umbrella coverage for the time of the accident.

    I think in this situation I’d stick with the attorney the insurance company assigns it to. I’ve seen it recommended that if you have your own claim it’s best to also get your own attorney, but since you’d just be defending here, let the insurance company handle it.

      Airbag burns hurt more than people think, and I’m glad the car seat worked like it should. Even if no one left in an ambulance, I’ve seen cases where someone felt fine at first but later realized they needed care. That’s why I’ve heard personal injury cases can still happen after the fact, especially if symptoms show up later.
