A problem I would see with your idea, (apart from my own personal moral disagreements) would be, how could you regulate it?
If people could kill rapists "in the act", how could we prevent cunning individuals setting up rape to kill someone they did not like (crimes of passion, Im not suggesting, "Hey its that guy who stole my pen at school", more "Its that bastard who slept with my wife")
They could easily get a good actress, or actor, to stage being raped by this individual, they could then kill this person.
It would be near impossible to regulate such a system, and as a result this could cause a "if she floats she be a witch" mindset, in which we would kill people without looking into the situation.
How easy was it to get a "witch" killed?
"My crops failed this year, and I heard Mrs.Ashcroft mumble something the previous harvest when my son fell into her garden"
This system would be impossible to regulate, unless it turned into a legal proceeding involving the death penalty, which would be a completely different matter.
Don't worry, you didn't come across as offensive, I just thought that you were right wing, and its usually very rare in such cases to be able to change somones opinion on crime, as usually it is an opinion you grow up with.
