Best Legal Weapon to carry

I got a question for you guys concerning 'legal' weapons. You see I live in New York City and the weapon laws are EXTREMELY strict over here. I believe the minimum years you can be sentenced to jail for carrying around a gun is 3 years and I am not too sure about knives but I know they are illegal here as well.

Is there any way to find out about weapon laws in local areas? It might sound stupid but I was thinking about just carrying around something as simple as a pen as a weapon to stab someone with in case I get into a fight with a few people. As a college student I could simply say its for school or that I always carry one around in my pocket. But I am pretty certain that injuring someone with something as simple as keys or anything sharp thats legal can get you in serious trouble as well.

Does anyone know the circumstances where using a legal weapon is justified? I believe I have read somewhere that you can only inflict as much damage as the attacker does to you. Is this really true?

The reason I am asking this is because I recently got into a street fight with 3 people and it all started because they were making racial insults toward me and when I had comforted them about it, the situation escalated to a fight. Luckily it was broken up quickly and no one really got hurt. But in a situation like that could u have just pulled out something like a pen and use it as a weapon?

This is true and not true. The same rules apply to you in the use of weapons as would to an officer. You may only use a weapon if the opposition has a weapon and or if you feel that your life is being threatened.

Also, in the court of law if you stab someone in the eye with a pen, it will be deemed the same way as a knife. You will have charges such as assault and battery and use of deadly weapon.

The problem is that most of your jury members have never had to defend their lives.

And now they have a guy in the courtroom that stabbed someone in the eye with a pen - and they think YOU'RE the monster as a result.

And the courtroom is really safe.. and when they are in that courtroom, they aren't in some back alley alone and scared.. So they have no real idea how you felt when you defended yourself..

This is why lots of innocent people who acted in self-defense go to jail afterwards.

The advice that you can use as much force as a police officer could in the same case is only half true. Because when the police officer goes to court, he's a pillar of the society who is expected to be in rough situations and sometimes to have to use force to get out of them.

You're just a civilian, and the jury won't look at you the same.

The fact is almost EVERYONE who commits a violent crime cries "SELF DEFENSE"!!!

It is a rare exception to actually meet the criteria that JUSTIFY your use of force.

While it is true that many believe what they did was reasonable it seldom PROVES to be in court.

I tend to advocate overwhelming force when it can be reasonably justified but don't take MY advise without consulting an attorney...

I carry a folding knife and a kubaton on my keyring. The average person just thinks it is some sort of fob. Haven't had a problem in most places. When I was on jury duty, I just carried a stout fountain pen which could be used as a kubaton. I have seen those videos where a defendant goes berserk attacking his attorney, and the bailiff has trouble with him.

I'm always ready, willing, able to help out in that situation.

OK. I'll leave the pen in my pocket and just pitch in with empty hands if the bailiff gets in trouble. I have to believe that if the bailiff was getting the short end of the stick, I would get a medal. If that causes me to end up in the calaboose, then I'll wait intil the dude jumps into the jury box after the conviction, and then I don't think anyone would blame me for anything.
